These Terms & Conditions govern the use of the FungyBar website and the purchase of products offered by FungyBar AS.
By accessing the website or placing an order, you agree to these Terms & Conditions.
Consumer purchases made through this website are governed by applicable Norwegian legislation, including the Norwegian Contracts Act, Consumer Purchases Act, Marketing Control Act, Right of Withdrawal Act, and E-commerce Act.
These laws provide consumers with mandatory rights that cannot be waived or limited by these Terms & Conditions.
Consumers residing outside Norway may also benefit from mandatory consumer protection rights applicable in their country of residence.

The individual placing an order is referred to as the Customer.
The agreement between FungyBar and the Customer consists of:
In the event of conflict between the various documents, separately agreed terms shall prevail unless prohibited by mandatory law.
The agreement is supplemented by applicable legislation governing the sale of goods between businesses and consumers.
FungyBar offers food products intended for general consumption as part of a varied and balanced diet.
We make reasonable efforts to ensure that product descriptions, ingredient lists, nutritional information, images, and pricing are accurate and up to date.
Because our products are made from natural ingredients, minor variations in appearance, colour, texture, and packaging may occur.
Customers are responsible for reviewing ingredient lists, allergen information, and usage instructions before consumption.
Prices are displayed in either Norwegian Kroner (NOK) or Euro (EUR), depending on the selected market.
For orders shipped within Norway, prices include applicable Norwegian VAT.
Orders shipped outside Norway are generally supplied on a Delivered at Place (DAP) basis unless otherwise stated. Customers may be responsible for local VAT, customs duties, import charges, or carrier handling fees imposed by the destination country.
No additional charges will be applied unless clearly disclosed before purchase.
Placing an order constitutes an offer to purchase products.
An order confirmation will be sent by email after an order has been placed.
The agreement becomes binding when payment has been successfully processed and the products have been dispatched.
FungyBar reserves the right to reject or cancel orders in cases of pricing errors, technical errors, suspected fraud, product unavailability, or circumstances beyond our reasonable control.
Orders may also be cancelled if the Customer knew or should reasonably have known that an obvious error had occurred.
Payment must be successfully completed before an order is processed and shipped.
Available payment methods are displayed at checkout and may be provided by third-party payment providers.
Where third-party services are used, their own terms and privacy policies may apply.
FungyBar does not store complete payment card information.
Delivery is completed when the products have been delivered to the Customer in accordance with the selected delivery method.
Any delivery times displayed on the website are estimates only.
Unless otherwise agreed, delivery will occur without undue delay and no later than thirty (30) days after the order was placed.

Risk for the products passes to the Customer upon delivery in accordance with Section 8.
Customers may have statutory rights of withdrawal in accordance with applicable law.
Statutory rights of withdrawal apply only where provided by applicable law.

For hygiene and food safety reasons, opened or unsealed food products cannot be returned where such exclusions are permitted by applicable law.
Unless otherwise stated, the Customer is responsible for the direct costs of returning products.
If delivery is delayed or not completed, the Customer may have rights under applicable consumer protection legislation, including the right to withhold payment, request performance, cancel the agreement, or claim compensation where applicable.
Customers should contact FungyBar promptly regarding any delivery issues.
Customers have statutory rights regarding defective products in accordance with applicable consumer protection legislation.
Complaints should be made within a reasonable time after the defect was discovered or should reasonably have been discovered.
Consumers residing in Norway have statutory complaint rights for up to two years from delivery, or longer where required by law.
Depending on applicable law, consumers may be entitled to remedies including repair, replacement, price reduction, cancellation of the agreement, or compensation.
Minor deviations in appearance that do not affect the safety, quality, or intended use of the product shall not in themselves constitute a defect.
Nothing in these Terms limits statutory consumer rights.
If the Customer fails to fulfil payment obligations or otherwise breaches these Terms, FungyBar may withhold delivery, cancel the agreement, or take other actions permitted by applicable law.
Uncollected shipments that are returned to FungyBar may be refunded less any shipping, return shipping, handling costs, or other actual costs incurred by FungyBar, where permitted by applicable law
FungyBar offers subscription products and recurring deliveries.
Subscriptions continue until cancelled by the Customer.
Subscriptions may be cancelled at any time before the next billing cycle.
Cancellation applies only to future orders and does not affect orders already processed or dispatched.
Any accumulated discount levels, loyalty rewards, or subscription benefits may be forfeited upon cancellation.
Subscriptions are subject to applicable consumer protection legislation, including any statutory rights of withdrawal where required by law.

These Terms & Conditions are governed by Norwegian law.
Nothing in these Terms limits mandatory consumer rights applicable in the Customer’s country of residence.
Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the Norwegian courts, unless otherwise required by mandatory consumer protection legislation.
